Plight of The Parsi Lying in Hospital in Mumbai

Thanks to the Zoroastrian Net, I was delighted to read of the existence of the Mehta Parsi Lying-In Hospital at Navsari. A maternity hospital established by the community donors to provide comfort & care to the community ladies in their hour of need, in this small town. A facility which started way back in 1912 for Parsi ladies only, as just a 4-bedded healthcare facility in the Mehta Cottage. The requirement was such that within a short span of a few years it had to be moved into the larger premises of the Mehta Hall. It soon grew from strength to strength into the present secular, multi-specialty healthcare facility for all. This brings into focus the dedication & dynamism displayed by the Trustees of the Hospital, past & present.

It is believed that a few years after its establishment the usage of the facilities by our community ladies reduced, making the functioning of the establishment financially unviable. The Management was thus compelled to seek an amendment to the Trust Deed to allow members of all communities the usage of the facilities. It was thereafter re-christened as The Dorabji Nanabhoy Mehta Sarvajanik (Cosmopolitan/Secular) Hospital.

    It has now been confirmed from official sources that the piece of land bearing Survey No CS-742, on which the PLIH stands, was given on lease for 99 years in March 1893 and the same expired in March 1993. Regrettably, NO ACTION was taken by the then Trustees nor those thereafter, to renew the same.

    It is further informed that a Notice was served by the Collector’s Office, on the Trustees in Dec 2018 drawing their attention to the expiry of the Lease & asking them to appear for a hearing for the renewal of the same. Thereafter, as per Order from the Collectors Office dated 22 Jan 2019, the renewal amount of Rs 3,56,26,989/ was ordered to be paid. The Order further stated that in the event of failure to pay the renewable amount within the prescribed period, action would be initiated under Section 53 (1) of the Maharashtra Land Revenue Act, 1966. This Order dated 22 Jan 2018 was challenged by filing an Appeal with the Maharashtra Revenue Tribunal (MRT), soon thereafter.

    It is further understood that, in addition to the Collectors Land under survey No CS-742, a part of the PLIH property also stands on BMC land under survey No CS-741. The 99-year lease of CS-741 has also expired.

    And there the case of the PLIH rests.

    The questions:

    Ø Why did the concerned Trustees (BPP/PLIH Trust) in 1993 & those who came thereafter, allow the Lease to expire?

    Ø Considering that the lease had expired in 1993 & not renewed, how did the concerned Trustees enter into an agreement with Krimson Healthcare Pvt Ltd in 2011/2012?

    Ø What was the understanding with Krimson Healthcare vis-a-vis the lease?

    Ø Why & with what intentions did the Trustees go into Appeal with the Maharashtra Revenue Tribunal?

    Ø Are the Trustees planning to re-commence the Healthcare operations at the PLIH as was done in the case of the Navsari PLIH?

    Ø If so, what is holding them up?

    Ø Dec 2023 – The Collector issues orders to take over the Gymkhana (name withheld) land citing mismanagement and violation of Lease Rules.

    Ø April 2024 – Land linked to a Govt charity hospital, given to builders. Records showed the land was handed over for redevelopment by changing the reservation from recreational to residential.

    Let’s hope good sense will prevail and we see the PLIH go the way te one at Navsari did.
